THIS NOTICE DESCRIBES HOW MEDICAL AND DENTAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN ACCESS THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our Legal Duty

The Health Insurance Portability and Accountability Act of 1996 known as HIPAA requires health care providers to protect the privacy of your medical and dental information.

We are required by law to

  • Maintain the privacy of your protected health information
  • Provide you with this Notice of our legal duties and privacy practices
  • Follow the terms of this Notice while it is in effect

We reserve the right to change our privacy practices and the terms of this Notice as permitted by law. Any changes will apply to all health information we maintain, including information created before the change. A revised Notice will be available in our office and on our website. You may request a copy at any time.

We maintain physical, electronic, and procedural safeguards to protect your health information in accordance with state and federal law.

Uses and Disclosures of Health Information

The following describes how your health information may be used or disclosed.

Treatment

We may use or disclose your health information to dentists, physicians, staff members, or other health care providers involved in your care. This includes referrals or consultations with specialists such as oral surgeons.

Payment

We may use or disclose your health information to bill and collect payment from you or your dental insurance plan for services provided.

Health Care Operations

We may use or disclose your health information for health care operations including

  • Quality assessment and improvement activities
  • Provider performance and credentialing
  • Training and licensing
  • Audits and fraud prevention
  • Business management, billing, and administrative functions

We may share information with other providers or health plans you have a relationship with for care quality review or fraud prevention as permitted by law.

Appointment Reminders

We may contact you with appointment reminders by voicemail, text message, email, postcard, or telephone. By providing your contact information, you agree we may leave messages unless you request otherwise in writing.

Family Members and Others Involved in Your Care

With your permission, we may disclose relevant information to a family member, friend, or other person involved in your care or payment. In emergencies or when you are unavailable, we may use professional judgment to determine what is in your best interest.

Health Related Products and Services

We may contact you about treatment options, dental services, or benefits that may be of interest to you. We do not sell your information.

Your Authorization

You may give written authorization for us to use or disclose your health information for purposes not described in this Notice. You may revoke that authorization in writing at any time, except where we have already acted on it.

We will not use your information for marketing or fundraising without your written authorization. You may opt out of such communications at any time.

Public Health and Legal Disclosures

We may disclose your health information without your authorization when required or permitted by law, including

Special Protections for Substance Use Disorder Records

Records related to the diagnosis, treatment, or referral for treatment of a Substance Use Disorder are protected by federal law under 42 CFR Part 2. These records may not be disclosed without your specific written consent or a court order, except as permitted by law. They cannot be used in legal proceedings, law enforcement investigations, or employment related actions without proper authorization.

Redisclosure of Substance Use Disorder records is prohibited unless expressly allowed by federal law.

Business Associates

We may disclose your health information to business associates who perform services on our behalf such as billing, software support, or accounting. All business associates are required by contract to protect your information.

Data Breach Notification

We will notify you if your protected health information is compromised through unauthorized access, use, or disclosure as required by law.

Additional Privacy Protections

Some information is subject to additional privacy protections under federal or state law including

  • HIV or AIDS related information
  • Mental health records
  • Genetic testing information
  • Alcohol or drug abuse treatment
  • Sexually transmitted diseases and reproductive health information
  • Child or adult abuse or neglect

When laws differ, we follow the law that provides the greatest privacy protection.

You have the right to

  • Inspect and receive a copy of your health records
  • Request an amendment to your health information
  • Request an accounting of certain disclosures
  • Request restrictions on certain uses or disclosures
  • Request confidential communications
  • Receive a copy of this Notice
  • Opt out of fundraising communications
  • File a complaint without fear of retaliation

Requests must be submitted in writing to our Privacy Officer.

If you believe your privacy rights have been violated, you may contact our Privacy Officer or file a complaint with the U.S. Department of Health and Human Services.
